SOCIAL CIRCLE CITY COUNCIL MEETING
NOVEMBER 19, 2007, 6PM
COMMUNITY ROOM
Mayor Burgess called the meeting to order with the following Council Members present:
David Terry, Angela Porter, Anne Peppers and Traysa Price. Also present were the City Attorney, Joe Reitman and City Clerk Susan Roper.
Mayor Burgess led the pledge of allegiance.
Debbie Conner Smith spoke to Mayor and Council regarding the proposals for changes in Town Park. It was suggested that the plans needed to go back through Planning and Zoning. Mayor Burgess explained to Mrs. Smith that City Hall staff would contact her regarding the issue.
Mayor Burgess reported that the Truck Route was moving along good with GDOT. He said the engineering was done. ROW was to be purchased in 2009 and Contract would be let in 2010.
The agenda was approved as presented with an executive session for potential real estate acquisition added to the end.
The minutes for October 15, 2007 and work session with HPC on September 24, 2007 were approved as submitted. All were in favor.
Vice Mayor Porter made a motion, seconded by Council Member Terry to approve the financial statements for October 2007 as presented with special notation to pursue collection of delinquent taxes. All were in favor.
Council Member Peppers made a motion, seconded by Vice Mayor Porter to approve the Comprehensive Plan Resolution attached. All were in favor.
Attorney Reitman read the HPC Ordinance Amendment. Council Member Peppers made a motion, seconded by Vice Mayor Porter to approve. All were in favor.
Council Member Terry made a motion, seconded by Council Member Peppers to make the following changes to the Utility Delinquent Policy:
§ Discontinue Hang Tags effective December 31, 2007
§ Increase delinquent fee from $10 Hang Tag and $10 Cut Off to $20 per
service (Water and Gas)
All were in favor.
City Clerk Susan Roper gave the following report on election returns from November 6, 2007 election:
Mayor Burgess 70 votes
Anne S Peppers 71 votes
Edward Shupe 17 votes
Council Member Terry made a motion, seconded by Council Member Peppers to approve the 2006-2007 Budget Amendments as presented (attached). All were in favor.
Mayor Burgess opened a public hearing giving 10 minutes for each side to hear public comment regarding Garden Mobile Home Park owned by Community Bank requesting to be rezoned from RMD to PUD.
§ Rezone request for Community Bank Garden Mobile Home Park. P&Z Chairman
Joe Johnston reported that the application to rezone had been denied by the
Planning and Zoning Commission because it was close to Highway 11 which is a
major commercial corridor making its best use commercial. After some discussion Dan Osborne, representing Community Bank requested that the matter be continued to a date certain. There being no others present to speak for or against the matter Mayor Burgess closed the public hearing. Council Member Terry made a motion, seconded by Council Member Peppers to continue until March 17, 2007. All were in favor.
Mayor Burgess opened a public hearing giving 10 minutes for each side to hear public comment regarding Circle Mobile Home Park owned by Community Bank requesting to be rezoned from RMD to PUD.
§ Rezone request for Community Bank for Circle Mobile Home Park. P&Z
Chairman Joe Johnston reported that the Planning & Zoning Commission recommended approval of the application to rezone from RMD to PUD in that a PUD would not adversely affect the area. There being no others present to speak for or against Mayor Burgess closed the public hearing. After some discussion Council Member Peppers made a motion, seconded by Council Member Terry to approve the application to rezone from RMD to PUD with the following stipulations in a development agreement:
o Abide by Judges orders to remove trailers
o All Masonry construction
o Landscape approval by tree board
o Underground detention pond or easement for offsite
o Pave and stripe parking
o 8’ Chain link fence on back of property
o Vegetative buffer on both sides.
All were in favor.
Mayor Burgess opened a public hearing giving 10 minutes for each side to hear public comment regarding Storey Mobile Home Park owned by Community Bank requesting to be rezoned from RMD to PUD.
§ Rezone request for Community Bank for Storey Mobile Home Park. P&Z
Chairman Joe Johnston reported that the Planning & Zoning Commission recommended approval of the application to rezone from RMD to PUD. There being no others present to speak for or against Mayor Burgess closed the public hearing. Council Member Terry made a motion, seconded by Vice Mayor Porter to approve the application to rezone from RMD to PUD with the following stipulations in a development agreement:
o Fence detention pond
o All Masonry construction
o Landscape approval by tree board
o Pave and stripe parking
o Greenspace (landscape)
o Abide by Judges orders to remove trailers
o Stream buffer requirements (150’ and drainage issue)
All were in favor
Traysa Price arrived at 7:07 PM
Mayor Burgess opened a public hearing giving 10 minutes for each side to hear public comment regarding an application from Mayfield & Pool Heating and Air to rezone 681 N. Cherokee Road from R15 to O&I to be used as a showroom, office and small warehouse space. P & Z Chairman Johnston reported that the Planning and Zoning Commission recommended approval. There being no others present to speak for or against Mayor Burgess closed the public hearing. Council Member Terry made a motion, seconded by Vice Mayor Porter to approve the application to rezone 681 N Cherokee Road from R15 to O&I. All were in favor.
Mayor Burgess excused himself from the following zoning matter with B&J Properties.
Vice Mayor Porter opened a public hearing giving 10 minutes for each side to hear public comment regarding an application from B&J Properties for a variance of the 75’ buffer to 20’ buffer. Property is located at the corner of E. Hightower Trail and Thurman Baccus. Chairman Johnston reported that the Planning & Zoning Commission recommended approval. There being no parties present to speak for or against Vice Mayor Porter closed the public hearing. Council Member Peppers made a motion, seconded by Council Member Terry to approve the variance from 75’ buffer to 20’ buffer for property owned by B&J Properties located at the corner of E. Hightower Trail and Thurman Baccus. All were in favor.
Vice Mayor Porter made a motion, seconded by Council Member Peppers to close regular session. All were in favor.
Vice Mayor Porter made a motion, seconded by Council Member Peppers to go into executive session to discuss potential real estate acquisition. All were in favor.
Council Member Peppers made a motion seconded by Council Member Price to close executive session. All were in favor.
Council Member Price made a motion, seconded by Council Member Peppers to return to regular session. All were in favor.
Meeting adjourned at 9:08 PM.
