Minutes for December 16, 2008

Mayor Burgess called the meeting to order with the following Council Members present? Anne Peppers, Angela Porter, Traysa Price and David Terry. Also present were City Attorney Joe Reitman, City Manager Doug White and City Clerk Susan Roper.

Mayor Burgess led the pledge of allegiance.

Mrs. Patsy Crain, 301 S. Cherokee spoke to Mayor and Council about a few matters that need to be addressed at 301 S. Cherokee and her neighbors. Mr. White assured her that he had taken notes of her concerns and would address them with her tomorrow.

Vice Mayor Terry made a motion, seconded by Council Member Porter to approve the minutes for November 18, 2008 as presented. All were in favor.

Council Member Peppers made a motion, seconded by Council Member Porter to approve the financial statements for November 2008. All were in favor.

City Manager Doug White reported that Annette Gibbs at 431 S. Cherokee had asked to be rezoned from R15 to OI. At the P&Z meeting last month it would determined that she would not be able to meet the buffer requirements so P&Z made a recommendation to Mayor and Council for a conditional use for a day care. Mayor Burgess opened a public hearing giving each side 10 minutes to speak. Mrs. Gibbs stated that she would like a conditional use to operate a day care at 431 S. Cherokee and keep the zoning as R15. There being no others present to speak for or against Mayor Burgess closed the public hearing. Council Member Peppers made a motion, seconded by Council Member Porter to approve the request for conditional use to operate a day care at 431 S. Cherokee for Annette Gibbs. All were in favor.

City Manager Doug White reported that Brittnay Cason at 575 N. Cherokee had made application for rezone from OI to R15. Mayor Burgess opened a public hearing giving each side 10 minutes to speak. Mrs. Cason stated that they had been unable to rent the property as OI and requested R15 so they could rent residential. There being no others present to speak for or against Mayor Burgess closed the public hearing. Council Member Price made a motion, seconded by Vice Mayor Terry to approve the request to rezone 575 N. Cherokee from OI to R15. All were in favor.

City Attorney Reitman reported that H A Walton, LLC and All Star Management LLC had submitted an application to annex into Social Circle 223 acres as AG2 on November 18, 2008. Since that time proper advertisement has run in both the Newton and Walton newspapers, proper notice posted on the property and public hearing held at the P&Z Meeting on December 15, 2008. Mayor Burgess opened a public hearing giving each side 10 minutes to speak. Mr. Greg Rosa reported that the land owners seek approval to annex into the City as AG2. Phyllis Pettaway at 901 Canon asked what AG2 Zoning was. There being no others present to speak for or against Mayor Burgess closed the public hearing.

City Attorney Reitman reported that H A Walton County, LLC and All Star Management LLC had submitted an application to annex into Social Circle 223 acres as AG2 on November 18, 2008. Since that time proper advertisement has run in both the Newton and Walton newspapers, proper notice posted on the property and public hearing held at the P&Z Meeting on December 15, 2008.Mayor Burgess opened a public hearing giving each side 10 minutes to speak. Mr. Greg Rosa reported that the land owners seek approval to annex into the City as AG2. John Miller asked what was the motivation to annex in. Mayor Burgess said that annexing in availed the property to the long term planning process for Social Circle. Also to be a part of a city that has a good public safety department, gas, water good schools, transportation, streets and it also makes property more valuable. He stated that annexing in before developing makes for better developments as the property must conform to City standards. There being no others present to speak for or against Mayor Burgess closed the public hearing.

Council Member Peppers made a motion, seconded by Vice Mayor Terry to approve the request to annex into Social Circle from H A Walton County LLC and All Star Management LLC 223 acres as recommended by the Planning & Zoning Commission. All were in favor.

Council Member Peppers made a motion, seconded by Vice Mayor Terry to approve an AG2 zoning for the 223 acres of annexed property for H A Walton County, LLC and All Star Management LLC. All were in favor.

City Manager Doug White reported that he had received a contract from CSX for $15,000 to work with the City’s engineer to repair the CSX Bridge on E. Hightower. Vice Mayor Terry made a motion, seconded by Council Member Peppers to approve the contract. All were in favor.

Mayor Burgess reported that the Downtown Project with Urban Collage required a steering committee to work with the consultants. A list of names was submitted for consideration by Mayor Burgess to Council. Council Member Porter asked that the matter be delayed until the called meeting on December 29, 2008.

Vice Mayor Terry made a motion, seconded by Council Member Porter to approve a lease with GMA for a maintenance truck for $40,083.00. All were in favor.

Council Member Price made a motion, seconded by Vice Mayor Terry to approve a lease with GMA for 3 police cars for $108,486.41. All were in favor.

Council Member Peppers made a motion, seconded by Council Member Price to approve the 2010 DOT Van Program Application Contract. All were in favor.
